These Terms of Service ("Terms") govern use of the SnowGo Operations platform (the "Service") operated by SnowGo National Services LLC ("we," "us," or the "Company"), 525 Royal Parkway, P.O. Box 290483, Nashville, Tennessee 37229. By accessing or using the Service — including the web application, the client portal, and the Service's calls and text messages — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Accounts and Roles
The Service supports administrator, dispatcher, subcontractor, and client roles, each with different capabilities. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use. Accounts are provisioned by the Company; you agree to provide accurate information and to keep your contact details current.
2. Acceptable Use
- Use the Service only for lawful snow and ice management operations.
- Do not attempt to access data or accounts you are not authorized to access.
- Do not interfere with, disrupt, or probe the Service or its infrastructure.
- Do not upload unlawful, infringing, or malicious content.
- Do not use the Service's messaging features to send spam or non-operational marketing.
3. Communications Consent
By providing a telephone number to the Company — in a service agreement, through the Service, or to our personnel — you consent to receive operational calls and text messages related to snow and ice services at that number, as described in the SMS Program Terms below. Calls placed through the Service may be recorded or transcribed for quality assurance and service records where a disclosure is played at the start of the call. Voicemails left on Service numbers are by their nature recorded, and are transcribed for dispatch handling.
4. SMS Program Terms
SnowGo Dispatch Alerts is an operational text-messaging program that sends dispatch, scheduling, site-coordination, and service-update messages to contracted subcontractors and to client contacts of the Company. It is not a marketing program.
- Consent. Consent to receive program messages is obtained through your service agreement or subcontractor agreement with the Company and is confirmed by an enrollment disclosure message sent to your number. Consent is not a condition of purchasing any goods or services.
- Message frequency varies based on weather events and operational activity.
- Message and data rates may apply. Contact your carrier for details.
- Opt out at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT. One final confirmation message will be sent, after which you will receive no further messages.
- Help. Reply HELP or INFO for help at any time.
- Re-enroll by replying START, YES, UNSTOP.
- Carriers are not liable for delayed or undelivered messages.

5. Field Staff Location
Subcontractors and field staff consent to the capture of GPS location and timestamps at service check-in and check-out as a condition of using the platform. This capture exists to verify that services were performed at the correct site and time, and becomes part of the Company's service records.
6. Service Records and Photos
Photos, notes, and records uploaded to the Service may be used by the Company for service verification, client reporting, defense and resolution of disputes and claims, and general operations. By uploading content, you grant the Company a non-exclusive, perpetual, royalty-free license to use, reproduce, and store that content for those purposes. You represent that you have the right to upload the content you submit.
7. Client Portal Share Links
The Service can generate share links that allow the link-holder to view service history for specific sites without a login. Anyone in possession of a share link can view the associated information; clients are responsible for controlling who they share links with. The Company or the client may request revocation of a share link at any time, and revoked links stop working immediately.
8. Weather and Informational Data
Weather data and similar informational content in the Service are provided as-is from third-party sources for operational awareness only, and are not guaranteed to be accurate, complete, or timely. The Company does not warrant that services coordinated through the platform will prevent all weather-related hazards, or that any surface will be free of snow or ice at any particular time. Site users remain responsible for exercising appropriate caution in winter conditions.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO USE OF THE SERVICE. THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID TO THE COMPANY FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not modify any separately negotiated service agreement between you and the Company.
10. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your content, or your misuse of the Service.
11. Termination
We may suspend or terminate access to the Service at any time for violation of these Terms or as needed to protect the Service and its users. Provisions that by their nature should survive termination — including record retention, licenses granted for service records, disclaimers, and limitation of liability — survive.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Delaware, and the parties consent to personal jurisdiction there.
13. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. We may update these Terms from time to time; material changes will be posted on this page with an updated "Last updated" date, and continued use of the Service after changes take effect constitutes acceptance. These Terms, together with the Privacy Policy and any service agreement between you and the Company, are the entire agreement regarding the Service. Where a signed service agreement conflicts with these Terms, the service agreement controls.
